HANSON CONSERVATION COMMISSION
MINUTES OF THE PUBLIC MEETING OF FEBRUARY 6, 2007
TOWN HALL, 542 LIBERTY STREET, HANSON, MA


Called to Order at 5:00 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Philip Lindquist, Chairman, in Meeting Room A on the top floor of the Town Hall.

Outstanding Administrative Items

OSP – RFP
Ms. Delaney had completed a draft of a Request for Proposal for the Open Space & Recreation Plan, copies of which were distributed to the members for review.  Mr. Lindquist suggested that a copy be forwarded to the Open Space Committee and that the project should be a joint effort between both Committees.  Ms. Delaney had researched the Conservation Fund which she surmised can be expended for this type of funding unless there is specific language that prohibits it.  She had looked diligently for such language, and could find none.

Operation and Maintenance Plans
Ms. Nehiley had created a binder that includes Operation and Maintenance Plans that have been submitted over time to the Conservation Commission.  Ms. Delaney suggested that a Commission member review the all the Yearly Operational Plans in terms of creating a schedule that would keep track of and determine who’s responsible for ongoing maintenance of detention basins, mowing, drainage, etc..  

Boilerplate OOC
Ms. Delaney reminded the Commissioners that Orders of Conditions need more comprehensive conditions that can be customized to meet the requirements of individual projects.

Outstanding Enforcement Issues

Pupek Property – corner of Main St and Crooker Place
The recent history of the site was related.  Fill had been placed at the edge of wetlands,  purportedly by a landscaper.  Ms. Delaney had written a letter to the Pupek’s advising them that the fill would have to be removed and that the lot was likely undevelopable.  The Pupek’s had hired a wetland scientist to delineate the lot and submitted a plan to the Commission showing existing conditions that included an ILSF (Isolated Land Subject to Flooding).  Ms. Delaney has concluded that the fill has been in place so long that to remove it at this point would do more harm than good.  The Commission agreed and suggested that she draft a letter.

632 State Street
Mr. Landreville had not responded to the Enforcement Order.  A fine was discussed.  Ms. Delaney will research and report for the next meeting.   

Ridder
Photos & E-mail from USACO – Army Corps of Engineers did a flyover on 12/6/06 to compare the bog area to five years ago.  Ms. Delaney received an E-mail from them commenting that it didn’t appear that anything was being done outside of the original footprint.  Ms. Delaney responded that the pictures didn’t show the pump house located on the northern part of the property or the extensive documented wetland fill on the western portion of the site.
        Cul-de-sac – Land Planning is currently working on the final plan.
Behind 99 Ransom Road – Ms. Delaney had spoken with someone from DEP in December and she hasn’t heard back.
        
41 Pearl Street – recent Enforcement issue
During an inspection in response to a Notice of Intent Filing for a septic upgrade, Ms. Delaney had noticed destruction of wetland in the form of vehicular traffic as well as some wetland fill.  Also, flags needed to be replaced to confirm the wetland line.  Ms. Delaney suggested that permanent setback markers be installed as mitigation for damage that had taken place.

Letter from residents of Pennsylvania Avenue
A letter requesting the matter of flooding at Pennsylvania Avenue be resolved was received.   Specifically, some neighbors felt that wetland fill in the Aghajanians backyard had contributed to flooding problems in their yards.  The Aghajanians had been asked by the Commission to submit a Request for Determination and a plan to establish a buffer zone in their backyard as mitigation for wetland fill.  As of yet, they had not done this.  The Commission had decided on calling the edge of yard the wetland line and that the other property owners on that side of the road maintain a 10-foot buffer as well.  Mr. Lindquist suggested another letter to the Aghajanians stating a deadline and a letter to the neighbors regarding the 10-foot buffer be drafted.  Also, Ms. Delaney will check in on Mr. Dumont’s progress on West Washington Street.
Memo from Meredith Marini regarding May Annual Town Meeting Warrant
The Commission discussed the issue of insurance for members.  With the possibility of health insurance, life insurance, or even a stipend, more younger people might be interested in serving.  Mr. Lindquist would like to see the Stillman property converted to Conservation.  Ms. Delaney mentioned that that was one of tasks of the RFP:  to identify properties under management of other departments converted to the jurisdiction of Conservation.
Bonney Hill Lane
Ms. Delaney reported that Bonney Hill Lane was not ready for a Certificate of Compliance.  Water is not flowing into the catch basin and is freezing in the driveway on the right hand side of the cul-de-sac.  She had talked to the owner who would be willing to give an easement if the Town was willing to maintain the swale and catch basin on her property. Paul Mirabito, the engineer for the project had sent a letter to the Commission stating substantial compliance.




Pilot Wetlands Bank/ Correspondence Data
Phil Lindquist had worked on a comprehensive filing system for all the correspondence/data that was and is being received regarding the Pilot Wetlands Bank.  The Consultant proposals were discussed briefly but a decision will not be made until monies are received from the applicant.

Factory Pond Dam
Ms. Delaney had contacted Victor Diniak from Hanover DPW in response to an inquiry by Mary Lou Sutter.  Hanover is going to analyze the repair of the dam and let us know the cost.  Dick Harris had agreed to pay for ½ of the evaluation.  A report will be prepared for the February 15th deadline.    
Agent’s Departure  
Ms. Delaney agreed to provide temporary assistance to the Commission in the transitional period between now and hiring a new agent.
